1. Acceptance of Terms

By accessing or using the MarkFlow application ("Service", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our Service.

2. Description of Service

MarkFlow is a client-side markdown editor application providing real-time preview, document organization, Google Drive cloud file sync, local client-side vault encryption, and optional AI writing assistance powered by Google Gemini and other LLM APIs. The Service operates directly within your web browser.

3. User Responsibilities

• Account & Credential Security: You are responsible for safeguarding your Google account, API keys, and Master Passwords. MarkFlow does not store your passwords or keys on external servers and cannot recover lost master passwords.
• Acceptable Use: You agree not to use the Service for any illegal, harmful, or unauthorized purpose.
• Third-Party AI & Cloud Services: When using Google Drive or AI features, you agree to comply with the terms of service of the respective third-party providers (e.g. Google, OpenAI, Anthropic).

4. Third-Party Integrations

MarkFlow integrates with Google APIs for authentication, AI generation, and Google Drive file sync. You acknowledge that:

• MarkFlow operates independently and is not owned by third-party API providers.
• Usage of third-party APIs is governed by your own accounts and agreements with those providers.
• We do not guarantee uninterrupted uptime or performance of third-party API endpoints.

5. Data Backup and Content Ownership

You retain full ownership of all notes and documents created in MarkFlow. Because MarkFlow is a local-first application, you are responsible for maintaining backups of your data using MarkFlow's built-in export features or Google Drive sync. We are not liable for data loss caused by clearing browser data or local device failure.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Limitation of Liability

IN NO EVENT SHALL MARKFLOW OR ITS CREATORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

8. Changes to Terms

We reserve the right to update these Terms at any time. Continued use of MarkFlow after updates constitutes acceptance of the modified Terms.
